HalalDocuments Terms of Service

A. I understand and agree that HalalDocuments is not a law firm or an attorney and may not perform services performed by an attorney. Rather, I am representing myself in this legal matter. No attorney-client relationship or privilege is created between HalalDocuments and myself.

B. If, prior to my purchase, I believe that HalalDocuments gave me any legal advice, opinion or recommendation about my legal rights, remedies, defenses, options, selection of forms or strategies, I will not proceed with this purchase, and any purchase that I do make will be null and void.

C. HalalDocuments exists solely within Wayne County in the State of Michigan. I agree that regardless of where I reside or where my browser is physically located, my viewing and use of HalalDocuments occurs solely within Wayne County in the State of Michigan, and that all content and services shall be deemed to be served from, and performed wholly within Michigan, as if I had physically traveled there to obtain such service. I agree that Michigan law shall govern any disputes arising from my use of this website, and that the courts of Wayne County, State of Michigan, shall have exclusive jurisdiction over any disputes.

D.I UNDERSTAND THAT HALALDOCUMENTS’ REVIEW OF MY ANSWERS IS LIMITED TO COMPLETENESS, SPELLING AND GRAMMAR, AND FOR INTERNAL CONSISTENCY OF NAMES, ADDRESSES, AND THE LIKE. I WILL READ THE FINAL DOCUMENT(S) BEFORE SIGNING IT (OR THEM) AND AGREE TO BE SOLELY RESPONSIBLE FOR THE FINAL DOCUMENT(S). I WILL HOLD HALALDOCUMENTS AND ITS AGENTS HARMLESS. IF THERE IS LIABILITY FOUND ON THE PART OF HALALDOCUMENTS, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU IF YOU LIVE IN SUCH A JURISDICTION.

E. I understand that the Site’s general terms of use (the “Terms of Use”) also apply to these Terms of Service and in agreeing to these Terms of Service, I acknowledge that I have read and agree to those Terms of Use, which are incorporated herein by reference.

F. HalalDocuments’ Document Storage Service. For purchasers of HalalDocuments’ Document Storage Service (“Storage Service”), HalalDocuments provides secure storage for copies of executed HalalDocuments estate planning documents (each a “HalalDocuments Stored Document”). The Storage Service is available to customers only in conjunction with the purchase of certain HalalDocuments products or packages. Do not send your original documents (each an “Original Document”). Customers using the Storage Service are encouraged to retain their Original Documents and provide HalalDocuments with copies of Original Documents as HalalDocuments Stored Documents. Customers should preserve Original Documents in a secure and safe location. The Storage Service is intended to provide a record of, and not to serve as a repository for, Original Documents. HalalDocuments will not accept Original Documents as HalalDocuments Stored Documents and, if apparent, will make reasonable efforts to return Original Documents received to you; provided, however, that if an Original Document is submitted and retained as part of the Storage Service, it will be deemed a copy and preserved as a HalalDocuments Stored Document.

  • Reservation of Rights. HalalDocuments reserves the right to store Stored Documents in any format, including hard and/or electronic copies. If you provide HalalDocuments with a hard copy Stored Document, you acknowledge that HalalDocuments may create an electronic copy of such Stored Document and destroy the hard copy. References to “photocopy” and “copy” in these Terms of Service and other HalalDocuments materials, including without limitation the Site, emails, letters, guides, and brochures, do not imply that HalalDocuments retains hard copies of Stored Documents. The terms “photocopy,” “copy,” and “electronic copy” are used interchangeably throughout these Terms of Service.
  • Limitation of Damages. HALALDOCUMENTS’ MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE DOCUMENT STORAGE SERVICES, AND IN NO EVENT SHALL BE GREATER THAN ONE HUNDRED DOLLARS ($100.00). BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

G. My purchase grants me a limited license to HalalDocuments’ Web-based system to create my own legal documents. I understand that, other than as required by applicable law, I shall have no right to cancel, request a cash refund, or obtain credit for any undelivered order after 120 days have elapsed from the purchase date unless HalalDocuments is at fault. All itemization of fees shall have no meaning and are only displayed for convenience. Both parties acknowledge that HalalDocuments is out of pocket time and money for undertaking the work and both parties fully intend to complete the order. Abandoned orders will result in liquidated damages equal to the amount paid to HalalDocuments for reimbursement of our commitment to service this order.

H. HalalDocuments uses a variety of carriers for each shipping option and will choose a delivery method for the shipping option and address you designate. If you select Overnight Delivery or Two-Day Delivery, you agree that HalalDocuments may use air or ground shipping as necessary to get your ordered documents to you within the required timeframe. The shipping fee indicated does not necessarily represent the actual amount paid by HalalDocuments to the carrier chosen for the delivery of your order. It may include, in addition to the fees paid to the carrier, reasonable HalalDocuments or third party handling and processing fees.

I. HalalDocuments shall not be considered in breach of or default under these Terms of Service or any contract with you, and shall not be liable to you for any cessation, interruption, or delay in the performance of its obligations hereunder by reason of earthquake, flood, fire, storm, lightning, drought, landslide, hurricane, cyclone, typhoon, tornado, natural disaster, act of God or the public enemy, epidemic, famine or plague, action of a court or public authority, change in law, explosion, war, terrorism, armed conflict, labor strike, lockout, boycott or similar event beyond our reasonable control, whether foreseen or unforeseen (each a “Force Majeure Event”). If a Force Majeure Event continues for more than sixty (60) days in the aggregate, HalalDocuments may immediately terminate these Terms of Service and shall have no liability to you for or as a result of any such termination.

J. By proceeding with your purchase, you agree to these Terms of Service.
